PRIVACY NOTICE

Information

In accordance with the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), RAM S.A. de C.V. (RAMSA) with address at Av. Desarrollo # 105, Zona Industrial, Postal Code 78395, in the municipality of San Luis Potosí, S.L.P., hereby informs you of the following:

The personal data that you have provided or will provide to RAMSA, including sensitive, patrimonial, or financial data, through requests, declarations, electronic and printed means in all its forms, videos, and other concepts, are collected with the purpose of providing you with the services we offer. These personal data will be used and processed exclusively for purposes related to meeting your requirements for the manufacturing of the products we offer.

We also inform you that in order to limit the use and disclosure of such personal data, we will maintain internal administrative, technical, physical, and confidentiality security policies and procedures.

If it is necessary to transfer such personal data for the payment of services provided by third parties unrelated to RAMSA, with whom services are subcontracted, we inform you that your personal data will be treated in accordance with Article 37 of the Federal Law on the Protection of Personal Data Held by Private Parties. The receiving third party will assume the corresponding inherent obligations, including safeguarding the privacy of the data.

Likewise, your personal data, including sensitive data, may be shared with notaries public and/or RAMSA's lawyers, for the purpose of legal acts related to the provision of our services.

If the data subject needs to revoke their consent or exercise their rights to access, rectify, cancel, or object to the processing of personal data (ARCO rights), they must do so through the person designated by RAMSA, whose contact details are described below:

The data subject may revoke their consent by accepting this notice. The revocation of consent granted electronically must be done following the procedure outlined below:

Send an email and/or a written request to the Responsible Department mentioned in this Notice, stating:

The full name of the data subject, address, and email address;

​

The reason for the request;

​

The arguments supporting the request;

​

Attach an official document that proves the data subject's identity and verifies that they are who they claim to be.

In accordance with Article 32 of the applicable law, RAMSA will notify the data subject of the resolution adopted within a maximum period of twenty (20) days, counted from the date on which the request for the exercise of ARCO rights was received. If the resolution is appropriate, RAMSA will proceed to execute it within fifteen (15) days following the date on which the resolution is communicated, through a written document or via email, indicating that all actions have been taken to stop the processing of the data subject's personal data.

If you do not express your opposition to the transfer of your personal data, it will be understood that you have granted your consent for such transfer, and this consent will be valid for all the services that RAMSA provides to you from now on.

RAMSA reserves the right to make modifications or updates to this Privacy Notice at any time, in order to comply with new legislative or jurisprudential provisions, internal policies, and/or new requirements for the provision of our services. This information will be available on the website www.ramsa.com.mx and/or through notices placed in our offices.

The parties agree that this notice shall be governed by the legal provisions applicable in the Mexican Republic, particularly those set forth in the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP) and its regulations.

In the event of a dispute or controversy arising from the interpretation, execution, or compliance with this notice or any of the documents derived therefrom or related thereto, the parties shall seek an amicable agreement within a period of thirty (30) calendar days from the date on which any difference arises and written notice is given to the other party regarding such event.

​

In case the parties do not reach an agreement, they both agree to submit any disagreements arising from this Privacy Notice or any of the documents derived therefrom or related thereto, definitively to the jurisdiction of the courts of San Luis Potosí, expressly waiving any other jurisdiction that, due to their present or future domicile, may correspond to them.
